Personal Data Protection Law No. 6698 Clarification Text
As Bali Dialysis Center, we act on the basic principle of protecting the privacy of private life by considering the fundamental rights and freedoms of our patients, their relatives, our employees, and all individuals interacting with us. Our institution securely stores all your personal data, including your personal health data, by taking the highest level of administrative and technical measures within the scope of the Constitution of the Republic of Turkey and the Personal Data Protection Law No. 6698 (KVKK).
This Clarification Text has been prepared with the aim of transparently informing you by Bali Dialysis Center, acting as the Data Controller, about which of your personal data will be processed for what purpose, to whom it can be transferred, the method of collection, its legal reason, and the rights you hold within the scope of the Law.
For What Purposes Is Your Personal Data Processed?
Your personal data (Your Identity Information, Contact Information, Location Data, Special Category Personal Data such as Health Information, Biometric / Visual Data) are processed to carry out the specific dialysis treatment services we offer uninterruptedly, qualified, and correctly in accordance with legal regulations, for the following purposes:
- Executing medical diagnosis, treatment, and care services completely in accordance with the Basic Law on Health Services No. 3359, Ministry of Health regulations, and the Regulation on Dialysis Centers.
- Opening patient files and completing legal registrations into hospital information management systems.
- Performing necessary statutory notifications to the Ministry of Health, SGK, and other relevant public institutions, such as E-Nabız, Medula, Merd-Sis (Dialysis Information System).
- Effectively planning special transportation and transfer services for our patients suitable for their home or logistics addresses (Location and contact data).
- Making appointments, generating result reports, and communicating with the patient or (with patient consent) patient relatives regarding dialysis session details and medical processes.
- Billing, SGK reconciliation, and management of financial processes with private health insurance companies.
- Ensuring facility security with camera recording systems and audit processes.
- Measuring patient satisfaction, evaluating complaints/requests, and operating internal audit and quality management systems within the framework of medical ethics rules.
To Whom Is Your Personal Data Transferred?
Bali Dialysis Center keeps your personal data completely confidential in full compliance with legislation. Your personal data may only be transferred to the following authorities when necessary and provided that the relevant legal rules are not violated, to ensure your medical treatment and fulfill legal obligations:
- The Republic of Turkey Ministry of Health, Provincial Health Directorates, and related affiliated public institutions and organizations.
- The Social Security Institution (SGK) and contracted private insurance/complementary insurance companies.
- External laboratory enterprises we have contracted with where laboratory tests are performed.
- Judicial authorities, courts, and other legal authorities authorized by law.
- Other medical institutions and relevant specialist physicians we refer you to for consultation purposes.
Your personal data is never sold, shared with third-party commercial organizations under any circumstances except for the exceptional and legally mandatory transfers mentioned above, and cannot be used for advertising / marketing purposes without informing you.
Data Collection Method and Legal Reason
Your personal data is collected orally, in writing, or electronically through your physical application to our clinic, forms you directly fill out, doctor observation notes, laboratory reports, our electronic systems, our cookie policy (website), and our call center.
Your "Health Data," which is special category personal data, is processed by persons under the obligation of keeping secrets for the purposes of protecting public health, preventive medicine, medical diagnosis, treatment, and care services without the need for your explicit consent. Other data is processed based on the legal grounds of establishing a contract or fulfilling our legal obligations.
What Are Your Rights Under KVKK?
You can exercise the following rights by applying to us in writing pursuant to Article 11 of the Law:
- To learn whether your personal data is processed, and if so, to request information regarding this,
- To learn the purpose of processing your data and whether they are used appropriately for their purpose,
- To request correction if your personal data is incomplete or incorrectly processed,
- To request the deletion or destruction of your personal data later under the conditions stipulated in the Law,
- To object to the occurrence of a result against you by analyzing the data exclusively through automated systems.
You can make all kinds of requests, suggestions, and information applications regarding KVKK directly in person to the patient rights or administrative units of Bali Dialysis Center with documents proving your identity, or via KEP / secure electronic signature pointing to iletisim@balidiyaliz.com. Our clinic will respond to your request free of charge within a maximum of 30 days.
